Refund Policy, Terms & Conditions

Our Contract

These Terms and Conditions govern the supply of goods sold by Spanset Limited of Telford Way, Middlewich Cheshire, CW10 0HX UK (“we” and “us”) to the customer named on the order form provided on the Spanset Limited website or in a Spanset Limited catalogue (“you”). Together with the completed order form, these Terms and Conditions constitute the entire and only agreement between us in relation thereto. Our acceptance of your order by delivery of the goods constitutes a legally binding contract between us on these terms and conditions.

Price & Payment

The price payable for the goods you order is as set out in our website at the time you place your order, plus any charges for carriage as set out in the order form.

We must receive payment for the whole of the price of the goods you order, and any applicable charges for carriage before your order can be accepted unless we have agreed otherwise in advance in writing.

All prices displayed in our catalogues both printed and online are subject to VAT where applicable. Prices are correct at time of publishing and are subject to change without prior notice. The price charged to the customer will be the prevailing price at the time of ordering.

Delivery

SpanSet are closed for their festive break from Tuesday 23rd December reopening on Monday 5th January 2009.
Orders received during this period will not be despatched until the 5th January 2009.

Terms and conditions for delivery are only applicable in the UK. For delivery outside the UK please contact our export department.

SpanSet will endeavor to meet any delivery date quoted but delivery dates are given and intended as an estimate only and if there are any circumstances whatsoever which prevent or delay delivery SpanSet Ltd shall not be bound to supply or make delivery of any goods ordered nor shall it be liable for any damage or consequential loss or in any other way for failure to supply or delay in delivery when so prevented or delayed.

Delivered goods may be subject to carriage charge.

Cancellation & Delivery

Non Delivery – claims for non-delivery must be made to SpanSet in writing within 10 days of despatch date show on the invoice.

Damage or Short Delivery -  Damage/shortages must be noted on the Carriers Delivery Sheet immediately and notice in writing given to SpanSet within 3 days of receipt of goods.

Return of goods - no goods (other than goods which reach the customers in an unusable condition) may be returned without the prior written consent of the SpanSet.   Where  SpanSet consents to such return, the goods must be received from the customer in good condition and the customer agrees to pay an administrative handling charge of 30% of the invoice value of the goods returned.

It is our normal practice to replace any merchandise, which might reach customers in an unusable condition. No handling charge will be made under these circumstances.

Liability

If you have notified us of a problem with the goods within 7 days of receipt, we will either make good any shortage or non-delivery; replace or repair any goods that are damaged or defective upon delivery or refund to you the amount paid by you for the goods in question. We will not be liable to you for any loss of profits administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the goods and we shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions. This does not affect your statutory rights as a consumer, nor is it intended to exclude our liability to you for fraudulent misrepresentation or for death or personal injury resulting from our negligence.

Force Majeure

We shall have no liability to you for any failure or delay in supply or delivery or any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including without limitation strikes lockouts and other industrial disputes).

General

If any part of these conditions is invalid or illegal unenforceable (including any provision in which we exclude our liability to you) the validity,  legality or enforceability of any other part of these conditions will not be affected. This contract shall be governed by and interpreted in accordance with English law.

VAT

All prices include VAT at 15% subject to changes in taxation.
